TERMS OF SERVICE

1. ABOUT US AND SCOPE

The online store mesaaxis.com ("Mesaaxis", "we", "us", "our") is operated by EFFETTO MODA SRL, an Italian limited liability company with its registered office at Corso Salvatore D'Amato 59, 80022 Arzano (NA), Italy, registered with the Business Register of Naples under REA number NA 783494.

These Terms of Service apply to every visit to our website and to every order placed through it. By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website or place an order.

2. WHO CAN ORDER

Our offer is aimed at consumers who are of legal age. By placing an order, you confirm that you are at least 18 years old or that you are using the website with the consent and under the supervision of a parent or legal guardian.

We currently deliver to addresses in Germany only.

3. PRODUCTS AND PRODUCT INFORMATION

We sell shoes for men and women, including everyday flats, loafers, boots, sneakers, sandals and dress shoes.

We do our best to describe and show every product as accurately as possible. Colours may look slightly different depending on your screen settings, and small differences in materials such as natural leather or suede are part of the character of the product and are not a defect.

If we discover an error in a product description, price or availability, we will correct it and inform you if your order is affected.

4. HOW A CONTRACT IS FORMED

The products shown on our website are not a binding offer but an invitation for you to place an order.

When you click the order button at the end of the checkout, you make a binding offer to buy the products in your shopping cart. Shortly afterwards you will receive an automatic email confirming that we have received your order. This email is not yet an acceptance of your order.

The purchase contract is formed when we send you a second email confirming that your order has been accepted or shipped, or when we deliver the goods to you.

Before submitting your order, you can review and correct all the information you have entered at any time. The contract language is English.

5. PRICES AND PAYMENT

All prices are shown in euros and include the applicable value added tax.

The shipping costs depend on the shipping option you choose and are shown clearly before you complete your order. Details can be found in our Shipping Policy.

You can pay with the payment methods shown at checkout. Payment is processed by external payment providers. We do not store your full card details ourselves.

6. DELIVERY

We deliver to Germany only. Delivery times and shipping options are described in our Shipping Policy. If a product you ordered is unexpectedly out of stock, we will inform you right away and refund any amount you have already paid.

7. RETENTION OF TITLE

The goods remain our property until they have been paid for in full.

8. RIGHT OF WITHDRAWAL

As a consumer, you have a statutory right to withdraw from your purchase within 14 days without giving any reason. All details, including how to return items, can be found in our Returns and Refunds Policy.

9. LEGAL GUARANTEE

All products are covered by the statutory legal guarantee for consumers under EU law and the Italian Consumer Code (Legislative Decree 206/2005). If a product is faulty or not as described, please contact us at info@mesaaxis.com with your order number, a short description and a photo of the issue.

Normal wear and tear, damage caused by improper use or care, and natural variations in leather and suede are not covered by the guarantee.

10. LIABILITY

We are fully liable for damage caused intentionally or through gross negligence, for injury to life, body or health, and in all cases where liability is mandatory by law.

In all other cases our liability is limited to foreseeable damage typical for this kind of contract. We are not responsible for temporary interruptions of the website caused by maintenance, technical faults or events outside our control.

11. USE OF THE WEBSITE

When using our website, you agree not to:

a) use it for any unlawful purpose
b) enter false or misleading information
c) upload viruses or other harmful code
d) copy, scrape or collect content or personal data from the website by automated means
e) try to bypass or interfere with the security features of the website

We may restrict or block access to the website if these rules are broken.

12. INTELLECTUAL PROPERTY

All content on this website, including texts, photos, graphics, logos and the design of the website, belongs to EFFETTO MODA SRL or its licensors. You may not copy, publish or use this content without our prior written permission.

13. REVIEWS, COMMENTS AND MESSAGES

If you send us feedback, ideas or comments, you agree that we may use them to improve our store without any obligation to pay you. Your messages must not violate the rights of others and must not contain offensive or unlawful content.

14. PERSONAL DATA

We handle your personal data in accordance with our Privacy Policy.

15. DISPUTE RESOLUTION

If you have a complaint, please contact us first at info@mesaaxis.com. We will do our best to find a fair solution quickly.

We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.

16. APPLICABLE LAW

These terms are governed by Italian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer, you also keep the protection of the mandatory consumer protection rules of the country where you normally live, in particular Germany.

17. CHANGES TO THESE TERMS

We may update these Terms of Service from time to time. The version published on the website at the time of your order applies to that order.

18. SEVERABILITY

If any provision of these terms is or becomes invalid, the remaining provisions remain in full effect.
